1. Who we are
This privacy policy applies to KH Group (AU) Pty Ltd (ABN 30 654 336 179), trading as Buyer Tenant Agency (referred to as “we”, “us”, or “BTA”). We are a Licensed Real Estate & Business Agent (Licence RA 81266) operating in Western Australia.
BTA is bound by the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This policy explains how we collect, hold, use, and disclose personal information, and how you can access or correct that information or make a complaint.

The kinds of personal information we collect depend on how you interact with us. They typically include:
- Identity and contact information: name, email address, phone number, postal address.
- Property and financial context (when you become a client or enquire about our services): price range, target areas, deposit position, finance pre-approval status, household composition, property goals, timing.
- Communications: messages you send via our website forms, email, SMS, phone, social media, or live chat.
- Marketing engagement: which lead magnets you downloaded, which emails you opened or clicked, which pages you visited.
- Technical information: IP address, device type, browser, referring URL, pages viewed, and similar data captured automatically when you visit our website (see Section 7 on cookies).
- Information from third parties: referrals from existing clients or partners, publicly available information (e.g. property records, business directories), and information passed to us by Meta (Facebook/Instagram) when you submit a lead form on their platforms.
We do not knowingly collect sensitive information (as defined under the Privacy Act) unless it is directly relevant to providing our services and you have consented.
3. How we collect it
We collect personal information in the following ways:
- Website forms: contact forms, callback requests, eBook and guide downloads, and landing-page enquiries on buyertenantagency.com.au and our campaign pages (e.g.
/go/,/go/homebuyer/). - Meta lead forms: when you fill in a lead form inside Facebook or Instagram in response to one of our advertisements, Meta passes that information to us through its native lead-ad integration.
- Direct contact: phone calls, SMS, emails, video calls, and in-person meetings.
- Live chat: our website chat widget (Zoho SalesIQ).
- Referrals: from existing clients, partners (e.g. mortgage brokers, accountants), and other property professionals who refer you to us with your knowledge.
- Cookies and trackers: automatically when you browse our website (see Section 7).
- Publicly available sources: e.g. property records, business directories, professional networks, where relevant to providing services or evaluating a property.
Where it is reasonable and practicable, we collect personal information directly from you. If we receive your information from a third party, we will take reasonable steps to make you aware of the collection.
4. Why we collect it and how we use it
We collect, hold, and use personal information for the following purposes:
- Providing our services: conducting buyer’s agent and property advisory work, including property search, due diligence, negotiation, and settlement coordination.
- Responding to enquiries: contacting you about your enquiry, scheduling discovery calls, and following up.
- Sending educational content and marketing: sending eBooks, market updates, newsletters, and information about our services. We do this only where we have your consent or another lawful basis under the Spam Act 2003 (Cth).
- Service improvement and analytics: understanding how visitors find and use our website, which content is useful, and where the funnel breaks down.
- Operating our business efficiently: using automated and AI-assisted tools for record keeping, follow-up and correspondence (see Section 9).
- Marketing attribution: measuring which marketing channels (search, social, referral) brought you to us, so we can invest in what works.
- Compliance: meeting our obligations under real estate, consumer protection, anti-money-laundering, taxation, and privacy law.
We will not use your personal information for a purpose that is unrelated to those above without first seeking your consent, unless we are permitted or required to do so by law.
5. Direct marketing and how to opt out
We may send you marketing communications by email or SMS where you have consented (e.g. by downloading a guide, subscribing to our newsletter, or becoming a client) or where it would be within your reasonable expectations.
Every marketing email contains a one-click unsubscribe link. SMS messages can be opted out of by replying STOP. You can also email info@buyertenantagency.com.au at any time and ask us to stop.
We honour opt-out requests promptly. Once you opt out, you will continue to receive transactional and service-related communications (e.g. messages directly relating to a property we are working on for you).
6. Who we share it with
We disclose personal information only where necessary to provide our services, run our business, or comply with the law. We share information with the following categories of recipient:
- Our team: authorised staff and contractors who need access to perform their role (e.g. buyer’s agents, lead qualification, marketing).
- Service providers and processors that help us operate the business, including:
- Customer relationship management (CRM), email marketing, and live chat platforms.
- Website and application hosting, automation, and supporting infrastructure.
- Analytics and reporting databases.
- Artificial intelligence service providers that help our team organise records, draft correspondence and analyse information.
- SMS, voice, and messaging providers.
- Advertising and analytics platforms — including Google (Google Ads, Google Analytics, Google Tag Manager, Google Workspace) and Meta (Facebook, Instagram, lead forms, and the Meta Pixel) — for advertising delivery, conversion measurement, website analytics, and business communications.
- Professional advisers — accountants, lawyers, conveyancers, and similar advisers — where relevant to a transaction we are working on for you.
- Property transaction parties — where you have engaged us to act for you, we may share relevant information with sellers’ agents, conveyancers, settlement agents, finance brokers, and inspectors as needed to progress the transaction.
- Government and regulators — where we are required to do so by law (e.g. taxation, anti-money-laundering, court orders, real estate regulation).
We require our service providers to handle personal information in line with this policy and applicable privacy law. We do not sell personal information.
7. Cookies, pixels, and online tracking
When you visit our website, we and our service providers use cookies, pixels, and similar technologies to:
- Remember your preferences and keep the site working correctly.
- Understand how you found us and how you use the site (Google Analytics 4, Google Tag Manager).
- Measure the performance of our advertising campaigns (Google Ads conversion tracking, Meta Pixel).
- Show you relevant content and advertising on other platforms (e.g. Facebook, Instagram, Google).
Specifically, we use:
- Google Analytics and Google Tag Manager — for behavioural analytics and tag deployment.
- Google Ads conversion tracking — to measure advertising performance.
- Meta Pixel — for advertising measurement and audience building on Facebook and Instagram.
- First-party attribution cookies set by us — to remember how you originally found us, so we know which marketing channel earned your enquiry.
- Live chat cookies — to power the website chat widget and identify returning visitors.
Your choices: you can control or block cookies through your browser settings. Most browsers also allow you to opt out of personalised advertising. You can opt out of Google Analytics tracking using the Google Analytics Opt-out Browser Add-on, and you can manage advertising preferences via your Facebook ad preferences and Google Ad Centre. Blocking cookies may affect how the website functions.
8. Cross-border disclosures
Many of the service providers and platforms described in Section 6 are based outside Australia or process data outside Australia. By using our services or our website, you acknowledge that your personal information may be disclosed to recipients located in the United States and in other countries, depending on each provider’s infrastructure. It is not always practicable to specify every country in which your information may be held or processed.
We take reasonable steps to ensure overseas recipients handle your personal information in a way consistent with the Australian Privacy Principles, but the legal protections in those countries may differ from Australia.
9. Automated processing and artificial intelligence
We use automated systems and artificial intelligence (AI) tools to help us run our business.
Automated follow-up. Our systems may send messages and update records without a person acting each time. For example, when you enquire, download a guide, book or miss a call, or reach a stage in our process, our systems may send you a text or email, place you in an email series that matches the type of property you asked about, or update the status of your enquiry in our records. These systems may use your name and contact details, the type of enquiry you made, the answers you gave on our forms, and the status and dates of your enquiry.
AI tools. Our team may use AI tools to help organise and maintain our records, read and draft correspondence, prepare our communications, and analyse how our marketing performs. The information these tools may process includes your identity and contact details, your communications with us, your enquiry and property preferences, and the property and finance context you have given us (such as price range, target areas, deposit position and finance pre-approval status).
Decisions about whether we act for you, our fees, and the properties we recommend are made by our team.
Some of these tools are provided by service providers located outside Australia, including in the United States (see Section 8, Cross-border disclosures).
If you have questions about how automated processing or AI is used in relation to your information, contact us using the details in Section 1.
10. How we hold and protect your information
We hold personal information in our CRM, analytics database, email systems, and supporting platforms operated by the service providers listed in Section 6. We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification, or disclosure, including:
- Restricting access to personal information to authorised team members on a need-to-know basis.
- Using reputable hosted platforms with their own security controls (encryption in transit, access controls, audit logging).
- Requiring strong authentication on accounts that hold or process personal information.
- Reviewing access and removing it when team members leave.
No system is perfectly secure. If a data breach occurs that is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) in line with the Notifiable Data Breaches scheme.
11. How long we keep it
We keep personal information only for as long as we need it for the purposes set out in this policy, or as required by law. In practice:
- Active leads and clients: for the duration of our relationship with you, plus a reasonable period afterwards (typically 7 years) to meet legal, tax, and professional obligations.
- Marketing subscribers who do not become clients: until you unsubscribe or ask us to delete your information, or until we determine the information is no longer useful.
- Website analytics: Google Analytics 4 retention is set to the platform default unless we change it. Aggregated and anonymised statistics may be kept indefinitely.
When personal information is no longer needed and we are not required by law to keep it, we will take reasonable steps to destroy or de-identify it.
12. Accessing, correcting, and deleting your information
You have the right under the Australian Privacy Principles to:
- Ask what personal information we hold about you.
- Ask for a copy of that information.
- Ask us to correct information that is inaccurate, out of date, incomplete, irrelevant, or misleading.
- Ask us to delete information we are not legally required to keep.
To make a request, contact us using the details in Section 1. We will respond within a reasonable time (usually within 30 days). We may need to verify your identity before releasing or correcting information. There is no fee to make a request, although we may pass on reasonable costs of providing access in unusual cases.
13. Complaints
If you believe we have mishandled your personal information, please contact us first using the details in Section 1. We take complaints seriously and will investigate and respond as quickly as we can.
If you are not satisfied with our response, you can refer your complaint to the Office of the Australian Information Commissioner (OAIC):
- Web: www.oaic.gov.au
- Phone: 1300 363 992
- Post: GPO Box 5288, Sydney NSW 2001
14. Children
Our services are directed to adults considering or undertaking a property purchase. We do not knowingly collect personal information from children under 16. If you believe we have inadvertently collected such information, please contact us and we will delete it.
15. Links to other websites
Our website may contain links to third-party websites (e.g. property listings, partner services, social media). We are not responsible for the privacy practices of those websites. We encourage you to read their privacy policies.
16. Changes to this policy
We may update this policy from time to time to reflect changes in our practices, our service providers, or the law. The “Last updated” date at the top of this policy will reflect the latest revision. Material changes will be highlighted on our website or, where appropriate, communicated to you directly.
